1. Our Contract with you
   No contract exists between you, the customer and us, Gowanbank Farms Ltd, Newton of Boysack, Colliston, Arbroath DD11 4PT, until such a time as your order for goods is confirmed at the point the goods are dispatched. 
   

   Gowanbank Farms Ltd shall not be deemed to have accepted your order until that time and may refuse or cancel your order, notwithstanding that an automatic confirmation of your order may have been received by you.

2. Pricing and availability
   Your credit or debit card will normally be charged at, or shortly after, the time that your order is placed. Prices for all goods are listed on the website. Prior to finalising you will be shown the total price for the goods inclusive of VAT and any delivery charges. In the event that we have sold-out of any items you have ordered, you will be informed by e-mail within 5 working days. 

   The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the products accurately, your product may vary slightly in size and weight.

3. Forms of payment
   We only take payment by credit or debit card or Paypal. Payments will be processed through Sagepay as our payment gateway. You must pay for the goods before we dispatch them. 

4. Your rights to make changes
   If you wish to make a change to the product you have ordered please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

5. Delivery
   Gowanbank Farms Ltd does everything it can to ensure that the goods are delivered promptly. However, time shall not be of essence in relation to your contract with Gowanbank Farms Ltd.

6. Delivery conditions
   If our supply of the products is delayed by an event outside our control then Gowanbank Farms Ltd will attempt to contact you and keep you advised of the likely date for delivery and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received. 

   Delivery shall be conditional upon access free from encumbrances and good roads being available to the delivery vehicles to the place of delivery. Gowanbank Farms Ltd will not accept any liability for damage to property caused during delivery. If the delivery vehicle cannot gain access to the delivery address, then additional costs may be payable. Our delivery vehicles are large and use tail lift offloading NOT CRANES. The delivery vehicle must be able to park where the delivery is to be made. A pallet truck is then used to manually manoeuvre the product off the vehicle to the KERBSIDE delivery point. This ground must be of tarmac or concrete and level and clear of obstructions like parked cars, overhanging trees or sharp bends. 

   If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery. 

   If you do not collect the products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract. 

   In such cases that delivery, in the opinion of Gowanbank Farms Ltd, is not possible, then the company reserves the right to cancel the order and apply the conditions detailed at 9.

   All deliveries are done between 8.00am and 6.00pm. Time is not of essence in this contract. 

7. Pallets and packaging
   All pallets and packaging are non-returnable.

8. Order cancellation
   This right of cancellation is derived from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCRs) and Consumer Rights Act 2015 (CRA) and applies only to persons falling within the definition of “consumer” as defined in the Regulations and the CRA as amended from time to time. This section does not apply if you are not a “consumer”. 

   You have the right to cancel your order at any time after your order is placed until 14 working days starting the day after delivery. You may exercise your right to cancel your order by writing to Gowanbank Farms Ltd, Newton of Boysack, Colliston, Arbroath DD11 4PT, or by e-mail to info@firewood-express.co.uk. 

   If Gowanbank Farms Ltd has already charged your credit or debit card prior to receiving notice of cancellation, Gowanbank Farms Ltd will refund the full price of the items cancelled within 14 days of your giving notice of cancellation. If the order has already been dispatched, the refund is subject to conditions as per section 9.

9. Returns policy
   If you end the contract for any reason after goods have been dispatched to you, you have the responsibility to take reasonable care of the goods and ensure they are returned to Gowanbank Farms Ltd at  Newton of Boysack, Colliston, Arbroath DD11 4PT in that condition. If you do not return the goods to Gowanbank Farms Ltd, you must make the cancelled items available to Gowanbank Farms Ltd, or its representative, for collection 

   We will pay the costs of return or collection: 

   1. if the goods are faulty or misdescribed; or
   2. if you have a legal right to do so as a result of something we have done wrong

   In all other circumstances including where you are exercising your right to change your mind, you must pay the costs of return or collection. 

   Your right to return the goods in this section 8 and your right to cancel set out in section 7  is in compliance with the CCRs and CRA and is in addition to your statutory rights which remain unaffected.

10. Losses
    Gowanbank Farms Ltd will only be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when the contract was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, goodwill or wasted expenditure). Gowanbank Farms Ltd does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty.  Subject to the preceding paragraph, Gowanbank Farms Ltd’s entire, aggregate liability to you under or in association with the breach of contract or negligence shall be limited to the payment amount received from you for the order in question.  

11. Governing law
    These conditions are governed by and construed in accordance with the laws of Scotland.

12. Alteration of service or amendments to the conditions
    We reserve the right to make changes to our Website Terms of Use, Privacy Policy, these Terms and Conditions of Sale and any other policy we may have, at any time. You will be subject to those policies including these Terms and Conditions of Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

13. Events beyond our reasonable control
    We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

14. Waiver
    If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions
